Town Council Approves Moratorium on New Short-Term Rentals

On Tuesday, August 22nd, the Town Council approved an ordinance establishing a moratorium on new business licenses for short-term rentals within Town limits. The purpose of the moratorium is to limit the creation and potential impacts of new short-term rentals until appropriate regulatory measures can be implemented. The ordinance took effect on August 22 and will remain in place for up to one year.

The limited moratorium applies only to new short-term rental business licenses, such as Airbnbs, VRBOs and other vacation rental properties.

It does not apply to existing short-term rentals (those active before August 22nd) that are compliant with current zoning requirements.

 

Overview

The Town of Magnolia Springs is embarking on a comprehensive evaluation process to assess the number, location and impacts of short-term rentals on the community. This evaluation will take into account concerns such as, neighborhood quality of life and impact on local businesses.

 

What is a Short-Term Rental?

A short-term rental is the rental of a room or residence of less than 180-days.

 

Am I effected by the limited moratorium?

The limited moratorium does not impact existing short-term rentals that are compliant with current zoning requirements.

 

How long is the moratorium in effect?

The moratorium will sunset on August 22, 2024, unless it is extended or shortened by the Town Council through the adoption of an ordinance before that date.

What is the Town doing to regulate short-term rentals in the future?

The Planning Commission is reviewing options for the regulation of short-term rentals. The Planning Commission plans to conduct Town Hall meetings for public engagement during the process. Once the Planning Commission drafts an ordinance, they will recommend it to the Town Council for approval. Potential regulations could include subjects such as noise, trash, zoning limitations, and public safety.
